It’s just a couple of weeks before your Pro-rated HVUT Form 2290 expires!

Hello there dear truckers, the Pro-rated HVUT Form 2290 is now due by 04/30/2020 for vehicles first used since March 2020. This deadline is been drafted by the IRS federal law that indicates that Form 2290 must be filed by the last day of the month following the month of its first use. And COVID-19 playing its role as our fate lies on it the govt is yet to announce any news relating to form 2290. You may even think if this deadline has anything to do about the regular Annual renewals which are basically due by June & payable until August. But, it does not. This deadline is only concerned about vehicles that are into service since March 2020.

The Heavy highway vehicle is basically paid on trucks with a minimum taxable gross weight of 55000 lbs and it’s paid for vehicles that are used over the public highways for commercial, agricultural & logging purposes. The desired mileage limit for exemption is drafted upon these vehicles based on the nature of its use.

For commercial based units & logging vehicles, the desired mileage limit of exemption is said to be 5000 miles each and for Agricultural based vehicles, it is said to be 7500 miles. Only when to seem to exceed the respective mileage based on your vehicle’s desired purpose of use you need to make the tax payment to the IRS full in advance for the period it needs to be reported.

The IRS HVUT Form 2290 Tax Refund and Credit Adjustments – Explained!

Now there are few claims that are supported in accordance with the Form 2290.

  1. Taxes Overpaid Credits.
  2. Suspended Vehicle Exceeds Mileage.
  3. Low Mileage Vehicle Credits.

Claims against Tax overpayment:  When the taxes are paid for a respective vehicle more than once within the same tax year, then the excess paid amount can be claimed as a refund by filing the Claim Form 8849 Schedule 6, as a result, you will receive a refund check back from the IRS in 21 business days in your mailing address.

When the vehicle is Sold/Destroyed/Stolen:  When the taxes are paid full in advance on a respective vehicle and if the subjected vehicle is Sold/Destroyed/Stolen a partial refund can be claimed via the Form 8849 Schedule 6.

Low Mileage vehicle credit:  When the taxes are paid full in advance on a vehicle assuming it would go over 5000 miles or 7500 miles but if the truck remains under the mileage limit for exemption during the year, the IRS lets you claim a full refund by the following tax year.

Commercial Drivers Have some Relief on their Expiring CDLs, Medical Cards and Tax Reporting

Truck drivers with expiring licenses or medical cards have been given an extension because of difficulties renewing during the COVID-19 crisis. The relief is from FMCSA, CVSA and IRS on certain tax extensions.

FMCSA Gives Commercial Drivers Extension on Expiring CDLs, Medical Cards 

  • The FMCSA issued a limited waiver for commercial drivers whose commercial licenses/permits and/or medical cards have expired or are set to expire after March 1st, 2020.
  • The waiver is effective immediately and valid through June 30th, 2020.
  • This comes as a response to state DMV and medical clinic closures that have made it difficult for commercial drivers to renew expiring licenses or medical cards.
  • Commercial drivers must still hold an appropriate license for the vehicle they are operating and must have been deemed physically qualified to operate a commercial motor vehicle.
  • Drivers and carriers should be aware that states may still enforce the prohibitions on operating a commercial motor vehicle without a valid, non-expired license, so attention should be paid to individual states.
